Scandal: Hillary Clinton aide Cheryl Mills has brazenly threatened to violate a court order and delete State Department emails. What role would she play in a Hillary Clinton administration? Investigation obstructor in chief?
Mills, Clinton and Clinton aide Huma Abedin were ordered on July 31 by U.S. District Court Judge Emmet Sullivan to produce "all responsive information that was or is in their possession as a result of their employment at the State Department."
Clinton has since told Sullivan that she has turned over all work-related emails from her private account, and Abedin's lawyer has told the media that "we have been working expeditiously to gather the remaining materials in Ms. Abedin's possession that are responsive or potentially responsive."
Mills' response to the judge? Drop dead. Well, not her exact words, but the essence of what her lawyers are saying. In a letter dated Aug. 6, the attorneys said that "following our production on Aug. 10, 2015, we have instructed (Mills) to delete any and all electronic copies (of potential federal records) in her possession."
Judicial Watch, which has been forcing the State Department to release the Clinton emails through a Freedom of Information Act lawsuit, calls this "one startling revelation."
When told of these plans, Sullivan ordered the three not to "delete any federal documents, electronic or otherwise, in their possession or control" and asked for "appropriate assurances ... that the above-named individuals will not delete any such documents."
The Clinton team has never been fully forthcoming about the personal email account handled by her private server that she used for business while secretary of state.
Judicial Watch first filed suit in 2013 seeking records about Clinton confidante Abedin and her employment outside the State Department while working there. The lawsuit was reopened in June at Judicial Watch's request because, in the understated words of Judicial Watch President Tom Fitton, "Clinton's massive email cover-up (was) unraveling."
Rather than cooperate throughout, the Clinton team, with help from the Obama administration, has slow-walked the process. It's as if it knew that a criminal investigation was coming — one has indeed arrived — and wanted to put it off as long as it could.
A reasonable person would be justified in thinking that Mills' plan to delete emails was just the latest hurdle thrown in front of the pursuit of justice and transparency.
Mills and the Clinton's go back a long way. She was Hillary's chief of staff when Clinton was secretary of state, and deputy White House Counsel when Bill was president. She was also part of the legal team that defended Bill during his impeachment trial.
